TourDash Terms of Service

1. Introduction

Welcome to TourDash. These Terms of Service ("Terms") govern your access to and use of TourDash's services, including our website, customer relationship management (CRM) features, and any other software or services offered by TourDash (the "Service"). TourDash is owned and operated by TourDash OÜ, Sepapaja tn 6, 15551 Tallinn, Harju Maakond, Estonia.

2. Acceptance of Terms

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Service.

3. Changes to Terms

We reserve the right to modify or replace these Terms at any time. We will provide notice of any significant changes by posting the new Terms on this page. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.

4. Access and Use of the Service

4.1. You must be at least 18 years old to use this Service.

5. User Data and Privacy

5.2. Limited License: You grant TourDash a limited, worldwide, non-exclusive, royalty-free license to use, reproduce, and process your User Data solely for the purposes of providing, maintaining, and improving the Service. This license is strictly limited to operations necessary for the functioning of TourDash.

5.3. Data Confidentiality: We understand the sensitive nature of CRM data. TourDash commits to treating your User Data as confidential information. We will not access, use, or disclose your User Data except as strictly necessary to provide the Service or as required by law.

5.4. No Public Sharing: TourDash does not share, sell, rent, or lease your User Data to third parties. Your data is not publicly accessible and is only used within the confines of providing the Service to you.

5.5. Data Security: We implement and maintain appropriate technical and organizational security measures to protect your User Data against unauthorized or unlawful processing and against accidental loss, destruction, damage, alteration, or disclosure.

5.6. Data Processing Agreement: For users subject to the General Data Protection Regulation (GDPR) or similar data protection laws, we offer a separate Data Processing Agreement that provides additional guarantees and details about our data handling practices.

5.7. User Responsibilities: You are responsible for ensuring that your collection and use of customer data complies with all applicable laws and regulations. You should only input data into TourDash that you have the right to use and share.

5.8. Data Deletion: Upon termination of your account, we will delete or return all User Data as per your instruction, except where we are required to retain such data by law.

5.9. Aggregated Data: We may use aggregated, anonymized data derived from User Data for our own analytics and service improvement purposes. This aggregated data will not identify you or your customers personally.

6. Prohibited Uses

You agree not to use the Service:

6.1. For any unlawful purpose or to solicit others to perform or participate in any unlawful acts.

6.2. To violate any international, federal, provincial or state regulations, rules, laws, or local ordinances.

6.3. To infringe upon or violate our intellectual property rights or the intellectual property rights of others.

6.4. To harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate.

6.5. To submit false or misleading information.

6.6. To upload or transmit viruses or any other type of malicious code.

6.7. To interfere with or circumvent the security features of the Service.

7. Intellectual Property

The Service and its original content (excluding User Data), features, and functionality are and will remain the exclusive property of TourDash and its licensors.

8. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

9. Limitation of Liability

In no event shall TourDash, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.

10. Disclaimer

Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied.

11. Governing Law

These Terms shall be governed and construed in accordance with the laws of Estonia, without regard to its conflict of law provisions.
